Marc Emery Plea Bargain Means Five Years in Canadian Prison and No Extradition to USA
By uncleweed on January 22, 2008 - 4:05pm
Marc Emery and his now-former co-defendants held a press conference this morning (Tuesday January 22nd) to discuss the plea bargain which results in no extradition to the USA. Emery, Greg Williams and Michelle Rainey made their remarks outside the BC Supreme Court house Downtown Vancouver to an assembled mass of journalists, supporters, activist and surprised passing barristers.
Vancouver Seed Bank Manager (and former editor of Cannabis Culture) Dana Larsen and colleagues were on hand to sell hi-grade marijuana seeds in $20 vials as a sign that selling seeds is a legally tolerated activity in Canada unlike the USA.
Marc Emery plead to a bargain of 5 years to be served in a Canadian prison instead of extradition to the USA to face a long, (likely fruitless) trial in Seattle and a sentence of up to life.

In my opinion ... the truly remarkable thing about the drown out campaign is how the extradition issue really crystallized conservative Canadians who don't care about marijuana legalization per se but grabbed a hold of the flagrant breach of sovereignty which occurred when the DEA-led campaign arrested Marc, followed by the extradition attempts. Trying to take a Canadian to be tried in the US on US charges!?!?! Asinine indeed and most of Canada agreed.
From NO Extradition
If Canadians have broken the law in Canada, they should be given a fair jury trial in Canada. If they wouldn't face any imprisonment in Canada for the charges laid, they should not be extradited to another country to face life imprisonment.
In Canada, a $200 fine -- not jail time -- is the BC Supreme Court appeals precedent for selling cannabis seeds (R. v. Hunter, 2000), and 58% of Canadians oppose extradition in this case (Strategic Counsel/Angus Reid polls).
It's clear Marc's 2 colleagues (Michelle Rainey and Greg Williams) were arrested as ransom to force a plea at minimum but fortunately their struggle will alleviate and charges will be dropped as part of the plea. The plea seems to come at a time when the personal vendettas have slowed due to political and economic shifts.
The Seattle-based former US district Attorney John McKay was fired in the recent Alberto Gonzalez roundup and he was the one waving the banner for Marc's demise. McKay was also the one famously grandstanding over the discovery of a tunnel from Langley to Lynden (as though that's the first one - heh).
Also, the DEA's Karen Tandy, who had a personal issues with Marc after his crew heckled Drug "Czar" Walters' nonsensical claims at a conference in Vancouver (complete with photo op), has moved on for a big paycheque at Motorola.

The deal would actually require Marc Emery be surrendered to the USA for a 3-9 month stay pending sentencing in Seattle. After being sentenced, the US is supposed to return him to Canada.
So extradition to the USA would still happen even if Marc takes a deal.
Which, by the way, he hasn't -- the deal is in negotiations, NOT accepted yet. Marc will not accept a deal if his co-accused have to serve any jail time. They were not included in the deal offer, but we want to force them to oblige.

He shouldn't agree to any deal that involves going to the US, period; once he's there, they'll fuck him up for sure. Besides, if he agrees to any such kind of a deal, the stir won't be as big, as if they actually extradicted him. So, I'd say his best bet is to wait this shit out.

hello America, the fight to the death for truth people next door who want Marc Emery to stop sending dope seeds to their youth to grow in a nation at war. To the USA, Emery is just another little weiner to be educated about the fine points of rights and responsibilities..
We are getting a little tired of this automatic transposing the corrupt evil rotton heart of sci fi Satania onto the handy template of the USA. When Emery is indeed marched before a very open and very public US court with the discerning eye of two nations media watching every wiggle to answer to charges regarding his actions.. what is he actually worried about?
I'll tell you- he is worried that he has finally tangled with people who are not buying his bullshit- who are there to stop law breaking . The Prince fears somebody calling his bluff, proving it and saying so.. and then doing something about it.. Not cruel and unusual punishments - no- he is looking at off the rack regular everyday penaltys .
Why did Canada not do this legal spanking herself? To her credit, Canada actually did..For ten years Canadian police raided him, Canadian Justices charged him, Canadian courts fined him, Canadian judges jailed him .. but alas, Mr Emery remorseless repeat offenderjust relapses into his comic book villain personna " the Prince of Pot " the moment he steps out of Canadian jails..
So did the USA overstep the rule of law and strong arm Canada to chase after their enemies - or did America cheat Canada of her own sovereignty to deal with crime? No// Emery went too far vending his contraband inventory bigtime for big money and simply went too far when he styarted selling across international borders and promptly got caught.. he was charged with selling several million pot seeds, which is a crime in both America and Canada.. and here comes the neibours to enforce the law of the continent ,
The USA is not playing 21st Nazi Goonsquad vs the 420 resistance slum heros.. No matter how fiercely the stoners insist it is.. they imagine themselves dressup heros defending their weed -they are loathe to consider that to everybody else they are just petty criminals..
Mr Emery and his stoner eletes black market ambitions attracted the notice of the Americans. If Emery is looking for the source of his woes , he need only look in a mirror. His shameless contraband profiteering brought the War on Drugs right to his door and to the country he claims to serve as a populist Drug Lord.
Lucky for Emery he got caught by America and not some other nation.. had he pulled this " Overgrow the Government" almost anywhere else on the planet he would have been shot..
Suddenly five years in jail seems like he got off easy..
I don't believe any man alive should be jailed, fined or treated otherwise for possessing seeds or plants or buds, for selling or for personal use. This is a personal matter, not a governmental issue, and they should have never been involved.
If we can drink legally but not out in public, we can smoke cigerettes which kill us everyday and the people around who don't smoke, like me for example, even the wiff of cigerette smoke and I gag and sometimes puke. But we cannot smoke a plant that does nothing more than make people tired and forgetful, and we can't because it effects the human mind, purhaps it could wake people up from the lies the government has had us in since birth.
We can take pills, which are what? DRUGS, oh they are 'over the counter drugs', so that means they are safe right? wrong, I'm willing to bet my life that more people have died from prescription drugs then from smoking weed.
The reality is this, if we have rights as a religious people, than all people who believe in Genisis of the bible are freely able to smoke pot without doing anything illegal?
The book speaks of "every herb bearing seed.." "every green leaf shall be meat for you" surely if it can be eaten it shouldn't be illegal, especially since it's a plant that has been on this planet since the beginning of time.
If pot was legal, there would be pretty much the same laws as alcohol because, the government wouldn't want you driving, or out in public while high.
So if Canada was to legalize Marijuana, it would have to consider that, smoking a joint in public isn't the same as being drunk in public, also, unless you get really high, most people are fine driving stoned, driving in all actuality doesn't require that much brain power, if you know what your doing you would be fine, laughing or being a bit tired isn't going to be like driving while drunk.
So if it were to be legalized certain laws surrounding it would need to have less penalties, maybe not the driving, but for sure smoking a joint out in public should be no crime, unless you don't believe your actually harming me with that cigerette? no way, if smokers can make me sick everytime I go out for fresh air, I should be able to smoke a joint where ever they stink up the air as well.
In conclusion, cigerettes, alcohol and pharmaceutical drugs are more likely to either give you a disease, cancer or kill you.
Thats what your government wants for you, not what you want, but rather the reality that you are a puppet on a string, and even the mild rebellian of our youth won't dent this system's strong hold.
The only freedom is to deny the government completely, if everyone denied the country's currency they would have no hold anymore and become completely useless, except of course they will still have control of everything, but only now you will see them for who they are, for they will turn the guns that they swore to protect you with against you and suddenly you will find yourself in a world of gang domination, the largest gang of all, the US government.
Freedom is your choice, it is the revolution, deny the money, the system will fall apart. Logically, community members would come together and grow crops of food for the surrounding areas, we would become independent of big cooperations and the people who wish to control our every moment alive.
Reading this just upsets me very much so. I live in the us and must say I can't stand it. Every step you make in life you have this big machine following you around with a leash on you. All the us is mad about is not there youth lol hell they send them to war at 18 to die and tell them they can't drink till 21. Wow what a joke this whole us is. All they are pissed about is Marc was making money on there soil and they was not paid. It's nothing more then a big money hungrey machine. I say Marc should tell them to go to hell with there deal and let them burn up in there small minded little heads. Hell this goverment supplied this country with drugs there self before to fuel there war. WTF. FTFW.
